Three important categories of unfür prejudice can be discerned: (1) breach of a formal agreement, (2) breach of an informal agreement, and (3) other circumstances where equitable considerations may arise. This approach, as described in the former paragraph, does not offer precise guidance as to what cases amount to unfür prejudice. Therefore, in this paragraph cases of unfür prejudice will be categorized in a case-to-case approach. It must be borne in mind that these categories are not limitative, but rather illustrative in nature. In addition, it is worth considering that there is a massive body of case law relating to the unfür prejudice remedy. Therefore, the following will only give a broad outline of cases that may be brought under the unfür prejudice remedy.
