316. Civil liability law builds upon an idea of proportionality and it is safe to say that this goes for civil liability rules in each Member State. As discussed in the case studies, the national courts in Angonese and Laval honoured the claims for compensation for damages for the infringements of Article 45 TFEU and Article 56 TFEU, respectively.1 Under Dutch law infringements of these Treaty provisions can be remedied by civil liability, especially through extra-contractual liability for a tortious act (Article 6:162BW).2
