In this article, the authors draw attention to the ins & outs of a system of dynamic bifurcation. Such a system is predicated on (i) a bifurcation of the arbitral proceedings in a first phase and a second phase, in particular a jurisdiction phase and a merits phase, and (ii) a replacement of – the majority of – the members of the arbitral tribunal after the first phase by new members.
