The division of tasks between the ECB and the national competent authorities with in the European Banking Union is set out in Article 6 SSMR. Outside the European Banking Union, the ECB plays no role in the supervision of the regulatory capital requirements.

When the regulatory capital requirements are – likely to be – breached by a bank, several measures can be imposed by the ECB1 or the nation al competent authorities.2 This section focuses on the measures that can be imposed by the ECB, but it should be kept in mind that national competent authorities can impose the same or similar measures.3
