The European Union’s strive for business rescue appears to be a means to multiple other ends, such as promoting entrepreneurship, maximising recovery rates for creditors and saving jobs. However, these underlying policy goals often conflict, complicating the drawing up of clear legislation and resulting in rules that are difficult to apply in practice.
