Similar to the appraisal right in the situation of conversion, I assume that the appraisal right of Art. 2:333h DCC has a mandatory character. The nature of the appraisal right seems to resist that this appraisal right can be excluded by contract beforehand. This subject is elaborated in § 7.3.1 further.
