10.2.1 Introduction

In this study, I have tried to answer the question as to what the costs of inquiry proceedings are, who can or should finance these costs, under which conditions, and why. I have based this study on three pillars of research: the costs of inquiry proceedings, the financing of the costs of inquiry proceedings, and related civil-liability law.

In the following, I will summarise the study and present my conclusions for each chapter. In chapter 2 I have examined the costs of investigation (par. 10.2.2), in chapter 3 the costs of defence of the investigator who is threatened by liability or held liable (par. 10.2.3), in chapter 4 the remuneration of officers – directors, supervisory directors or administrators – appointed by the Enterprise Chamber (‘EC officers’) (par. 10.2.4), in chapter 5 the defence costs of EC officers who are threatened by liability or held liable (par. 10.2.5), in chapter 6 the financing of the costs of inquiry proceedings (par. 10.2.6), in chapter 7 recovery of the costs of investigation (par. 10.2.7), and in chapter 8 the inquiry procedure as a stepping stone to liability proceedings (par. 10.2.8). I conclude with some final and overall considerations (par. 10.2.9).
