This subsection addresses other parts of law and regulation that influence independence. It focuses on conflicts of interest which are the central theme in this subsection. A SNED might be qualified as independent, but a transaction in which he has a personal interest can affect his independence (temporarily). The way that these conflicts of interest are dealt with is therefore important for his independence and the independence of the whole board. Besides conflicts of interest, this subsection addresses evaluations and diversity.
