My main conclusion after the present investigation is that it is possible, for the time being, to work with pseudo-succession law with binding elements. A new system of purely contractual succession law as in Germany or as we had before January the first, 2003, is not missed for now. If the legislator can create contractual possibilities with article 4:82 DCC and article 4:74 DCC and if attention is given to the administration option and the exclusion clause, testators can, to my mind, be helped in a simple manner. It is desirable to explicitly allow (certain) testamentary cautios in article 4:4 paragraph 1 DCC.
The advisor, particularly the civil-law notary must pay heed to pseudo-succession law and offer it, when appropriate, in a tailor-made manner to his client.
