A.9.5. Transitional law regarding pseudo-legacies unacceptable

The transitional law, namely pertaining to the pseudo-legacies of article 4:126 paragraph 2 under a DCC, is unacceptable, contrary to legal certainty and vitiates rights that have been acquired. At any rate, there has been a lack of understanding regarding arrangements that existed under former succession law, that were often advised – and even approved by the Dutch Supreme Court – which led to certainty for the parties concerned. An old aleatory contract no longer provides the absolute certainty parties could expect.This won’t do. I refer to no.1.15 of chapter IV.
