In English law, there is a difference between the measure of damages based on tort principles and the measure of damages based on contract principles.1 In this subsection, I will discuss the measures of damage for section 90 FSMA 2000 claims, fraudulent misrepresentation or deceit, negligent misrepresentation and innocent misrepresentation respectively.
