Een trust kan op diverse wijzen tot stand komen en onderverdeeld worden in verschillende categorieën. Een algemeen aanvaarde classificatie van de trust is er tot heden in het Anglo-Amerikaanse trustrecht evenwel niet.1 Vanwege de variatie in classificatie van trusts, kan een bepaalde trust de facto onder meer dan één categorie vallen.2 De thans meest voorkomende categorieën kunnen worden onderscheiden op basis van:
De ontstaanswijze;
Het doel dat met de creatie van de trust wordt nagestreefd;
De omstandigheden waaronder een trust tot stand komt.3
In het onderstaande worden de trustcategorieën aan de hand van de meest gehanteerde indeling in het Anglo-Amerikaanse recht, uiteengezet.
