By generating more procedural litigation, Warren Court decisions produced less litigation of the merits of criminal charges: whether the defendant committed the relevant crime, acted with the requisite intent, or had some available defense. That cannot help the justice system do its core job of separating those who deserve criminal punishment from those who do not.1
